RAPIDJ END USER LICENSE AGREEMENT - VERSION 1.0
IMPORTANT - READ CAREFULLY. This End User License Agreement ("EULA")
is a legal agreement between you (a person or a single entity) and
Code Canvas Technologies Pty Ltd ("LICENSOR"). By downloading,
installing or otherwise using RapidJ and any associated materials
(collectively, the "SOFTWARE") you indicate that you understand and
agree to the terms and conditions of this EULA. If you do not agree
to the terms and conditions of this EULA then do not download,
install or otherwise use the SOFTWARE.
1. LICENSE TO USE
LICENSOR grants you the following non-exclusive rights provided
that you comply with all terms and conditions of this EULA:
1a. This section applies to you if you have purchased a license
for the SOFTWARE. You may download, install and use the
evaluation version of the SOFTWARE. LICENSOR will e-mail you
a license key that can be applied to the evaluation version
of the SOFTWARE to unlock the functionality associated with
the purchased license. If the license has an expiry date then
from that date onwards functionality of the SOFTWARE will be
restricted to that found in the evaluation version. If you
have purchased a single-user license then at any one time you
are permitted to have the license key applied to at most one
copy of the SOFTWARE. If you have purchased a multi-user
license then at any one time you are permitted to have the
license key applied to at most the number of copies of the
SOFTWARE indicated by the license. You are entitled to free
e-mail support and free upgrades for the duration of the
license.
1b. This section applies to you if you have not purchased a
license for the SOFTWARE. LICENSOR grants you an evaluation
license to download, install and use the evaluation version
of the SOFTWARE for evaluation purposes only. An evaluation
license key is included in the evaluation version of the
SOFTWARE. The evaluation version has restricted functionality
and can be used for an unlimited amount of time. LICENSOR is
not obliged to provide support for the evaluation version of
the SOFTWARE.
1c. This section applies to you if you are using a beta version
of the SOFTWARE. You acknowledge that the SOFTWARE is a
pre-release version that does not represent the final quality
of the SOFTWARE and may contain bugs, errors and other
problems that may cause system failures or data loss. The
beta version of the SOFTWARE is provided "as is" and VENDOR
disclaims any warranty or liability obligations to you of any
kind. LICENSOR grants you a beta license to download, install
and use the beta version for evaluation purposes only.
LICENSOR will e-mail you beta a license key. The beta license
has an expiry date and from that date onwards the
functionality of the SOFTWARE will be restricted to that
found in the evaluation version.
2. RESTRICTIONS
2a. You may not copy, lease, loan, sell, rent or distribute the
SOFTWARE, with the exception that a single copy of the
SOFTWARE can be made for backup and archival purposes only.
2b. You may not modify, decompile, disassemble or reverse
engineer the SOFTWARE without written permission from
LICENSOR, with the exception that you may modify template
files (files ending with ".ftl") ("TEMPLATE FILES") and files
generated or produced by the SOFTWARE ("GENERATED FILES").
You may not avoid, bypass, defeat, deactivate or otherwise
circumvent any software protection mechanisms designed to
restrict the functionality of the SOFTWARE.
3. THIRD PARTY PRODUCT LICENSES
The SOFTWARE contains the following software products, which are
provided to you subject to their respective license terms:
3a. The SOFTWARE contains Alloy Look&Feel Copyright (c) 2002-2003
by INCORS GmbH, Simon-Dach-Str. 21, 10245 Berlin, GERMANY.
LICENSOR grants you permission to use Alloy Look&Feel as part
of the SOFTWARE only.
3b. The SOFTWARE includes software developed by the Visigoth
Software Society (http://www.visigoths.org/). It is licensed
royalty free and subject to the Freemarker License
(http://freemarker.org/docs/app_license.html).
3c. The SOFTWARE contains JavaHelp Copyright (c) 2002, Sun
Microsystems, Inc. All rights reserved. JavaHelp is licensed
royalty-free according to the terms of Sun Microsystems, Inc.
Binary Code License Agreement and JavaHelp Version 2.0

3d. The SOFTWARE includes HSQLDB software Copyright (c)
1995-2000, The Hypersonic SQL Group. All rights reserved. and
Copyright (c) 2001-2004, The HSQL Development Group. All
rights reserved. It is licensed royalty free according to the
terms of hypersonic_lic.txt and hsqldb_lic.txt
(http://hsqldb.sourceforge.net/web/hsqlLicense.html).
3e. The SOFTWARE contains TableSorter software Copyright
1994-2004 Sun Microsystems, Inc. All Rights Reserved. It is
licensed royalty free according to Code sample License - Sun
Microsystems, Inc.

3f. The SOFTWARE includes Commons Bean Utils, Commons Digester,
Commons Codec, Commons Logging, Log4J and Commons HttpClient
all Copyright 2002-2004 The Apache Software Foundation. They
are provided royalty free according to Apache License Version
2.0 (http://www.apache.org/licenses/LICENSE-2.0.html).
3g. The SOFTWARE includes Jakarta ORO Copyright (c) 2000-2002 The
Apache Software Foundation. All rights reserved. It is
provided royalty free according to Apache License Version 1.1
(http://www.apache.org/licenses/LICENSE-1.1).
3h. The SOFTWARE includes util.concurrent, Copyright Doug Lea.
3i. The SOFTWARE includes Resin, copyright 1998-2005 Caucho
Technology, Inc. (http://www.caucho.com/). It is licensed
royalty free and subject to the Caucho Developer Source
License 1.1 (http://www.caucho.com/sales/license.xtp).

4. LICENSE TO DISTRIBUTE REDISTRIBUTABLES
This section refers to all TEMPLATE FILES provided with the SOFTWARE
and all GENERATED FILES ("REDISTRIBUTABLES").
4a. This section applies to you if you have purchased a license
for the SOFTWARE. You are granted non-exclusive,
non-assignable right to distribute the REDISTRIBUTABLES in
text or binary form provided that:
(1) You do not remove or alter any proprietary legends or
copyright notices contained in the REDISTRIBUTABLES,
(2) You only distribute the REDISTRIBUTABLES in conjunction
with or as part of an application developed by you that
adds significant functionality to the REDISTRIBUTABLES,
(3) You include a license agreement that prevents further
redistribution of the REDISTRIBUTABLES by your end user
and protects LICENSOR’s interests consistent with the
terms and conditions of this EULA, and
(4) You agree to defend and indemnify LICENSOR from and
against any damages, costs, settlement amounts and/or
expenses (including attorneys' fees) incurred in
connection with any claim, lawsuit or action by any third
party that arises or results from the use or distribution
of your application.
4b. This section applies you if you have not purchased a license
for the SOFTWARE. You may not redistribute the
REDISTRIBUTABLES in any way.
5. COPYRIGHT AND INTELLECTUAL PROPERTY RIGHTS
The SOFTWARE is protected by copyright laws and international
copyright treaties, as well as any other intellectual property laws
and treaties. The SOFTWARE is licensed, not sold. There is no
transfer to you of any title to or ownership of the SOFTWARE, and
this EULA shall not be construed as a sale of any right in the
SOFTWARE.
6. TERMINATION
If you are found to be in breach of the terms and conditions
outlined in this EULA then the EULA will be terminated. In such
events you must immediately uninstall all copies of the SOFTWARE and
destroy backup copies. You are required to submit a signed statement
to LICENSOR indicating that the SOFTWARE has been erased and backup
copies destroyed.
7. DISCLAIMER OF WARRANTY
The SOFTWARE is provided "as is". Unless otherwise specified in this
EULA, all express or implied conditions, representations and
warranties, including any implied warranty of merchantability,
fitness for a particular purpose or non-infringement are disclaimed.
All risk arising out of the use or performance of the SOFTWARE
remains with you.
8. LIMITATION OF LIABILITY
In no event will LICENSOR or it's suppliers be liable for any lost
revenue, profit or data, or for special, indirect, consequential,
incidental or punitive damages, however caused regardless of the
theory of liability, arising out of or related to the use or
inability to use the SOFTWARE, even if LICENSOR has been advised of
the possibility of such damages. In no event will LICENSOR or it's
suppliers liability for any claim, whether in contract, tort or
other theory of liability exceed the license fee paid to LICENSOR,
if any.
9. REFUNDS
An evaluation version of the SOFTWARE can be downloaded for free
from the website. It is recommended that you use this to evaluate
the SOFTWARE before making a purchase decision. Refunds are given at
the discretion of LICENSOR.
